Gardner defends handling of Fathom contract
Former City Manager Andrea Gardner defended her handling of the contract with Fathom Tuesday, saying all contracts during her tenure were supposed to be reviewed by the city attorney’s office.
During a townhall meeting last Friday, City Manager Ryan Haverlah said the $7 million contract with Fathom was written in favor of the company. “The contract did not allow us to get out of it,” he said. “Unfortunately that contract was prepared in the favor of Fathom.”
He was asked later during the meeting if the city attorneys had reviewed the contract. “The city attorney did not review the contract with Fathom,” said Haverlah. “They were the turnkey company, including issuing the debt for the meters we were purchasing. We asked a bond council to review that contract.
“That contract changed about five times before it went to council,” he said. “The city attorney never reviewed that contract. The city attorney said, ‘Where’s the contract?’ They said we would have never approved this.”
